Therefore, based on
the new evidence, a 440.10 motion to Vacate Judgement has been filed in
the Bethel Justice Court with a return date of May 13, 1998.
(This motion has never
been decided upon by the Bethel town justice.)
The same evidence also reveals a shady chain of title and fraudulent filing of documents surrounding the last four transfers of the Woodstock site and a criminal conspiracy to defraud and deprive the public and the people of the State of New York of their rights to continue to assemble on the Woodstock site, which is sacred to them.*

FOUND GUILTY
OF TRESPASS!
Six people, defending the
absolute property right of the public to be on the Woodstock site,
overnight,
with a fire, set up tents on the Woodstock site in July of 1997. They were
charged with trepass by persons and corporations, who alleged to be the
owners of the Woodstock site, because they wouldn't take down their
tents. They were arrested by the State Police and prosecuted, on behalf
of the people of the State of New York, by the Sullivan County District
Attorney in the Bethel Town Court on September 29, 1997. All were found
guilty of trespass and, at the request of the District Attorney, were then
ordered, by the judge, not to go back on the property or they will be arrested
and charged with contempt of court.
However, this doesn't
apply to anyone else.
The defenders immediately moved for an appeal
The case for appeal is assigned to Sullivan County Judge Frank Labuda.
Bethel Town Justice Albert Fimognari, who handled the trespass case, refused to pass "his" audio tapes of the trial on to Judge La Buda as part of the record on appeal.
A motion was then made to Judge La Buda by Richard Newberg, attorney for the defendants, to have the audio record of the trespass trial made part of the record on appeal.
Motion was denied by Judge La Buda, at the request of Sullivan County District Attorney Stephen Lungen, which means the tapes would not become part of the record. Not good. However, a copy of the written transcript of the tapes, submitted by Richard Newberg is filed in the appellate court record.
